Permit for Life? The Firearms Liberty Act and its Potential Implications

Firearms Liberty Act Cover

North Carolina is on the verge of a significant shift in its gun legislation with the introduction of House Bill 674, also known as the “Firearms Liberty Act.” This bill proposes the creation of a lifetime concealed handgun permit, allowing residents to carry concealed firearms without the need for periodic renewals. The bill has passed the state House and is currently under consideration in the Senate.

What are some key provisions of the Firearms Liberty Act?

Under the current law, concealed handgun permits in North Carolina are valid for five years and require renewal, including a background check and, in some cases, additional training. The proposed lifetime permit would maintain the initial requirements for background checks and training, but would eliminate the need for renewals.

The traditional five-year permit would still be available, as the lifetime permit would be valid only within North Carolina and would not have reciprocity with other states.

This bill also includes provisions for:

  • Permit Renewal Flexibility: Extending the period during which expired permits can be renewed without retaking the training course.
  • Firearm Storage Options: Allowing individuals under domestic violence protective orders to transfer their firearms to licensed dealers for storage or sale.
  • Safety Hold Agreements: Providing liability protection for agreements between firearm owners and licensed dealers for voluntary firearm storage during crises or extended absences.

What are the arguments for and against the Firearms Liberty Act?

Proponents of the Firearms Liberty Act argue that it simplifies the process for law-abiding citizens to exercise their Second Amendment rights and reduces bureaucratic hurdles. They emphasize that the initial vetting process remains rigorous, ensuring that only qualified individuals receive permits.

Opponents express concern that eliminating periodic renewals could allow people who become disqualified over time – due to mental health issues or criminal activity – to continue carrying concealed weapons without reevaluation. They argue that regular renewals serve as a safeguard to reassess permit holders’ eligibility.

What are the implications of this bill – for North Carolina and beyond?

If this bill passes, North Carolina would join a growing number of states modifying their concealed carry laws to reduce restrictions. This move could influence similar legislation in other states and contribute to the national debate on gun rights and public safety.

The bill’s progress is being watched by both gun rights advocates and gun control supporters, as it has the potential to set a precedent for how states balance individual rights with community safety concerns.

What are the public’s thoughts on lifetime permits?

Firearms Liberty Act Poll

We asked the Concealed Coalition community what they thought about having one permit with no renewals required, and here’s what they said:

At the time of this blog’s publication, 88% of respondents answered that they would support a lifetime permit, while 12% maintained that they were not a fan.

There was also some further discussion and debate in the comments:

“Training is essential to ensure safety. I voted yes, but there should be something in there about the decline of mental faculties. If you really get into thinking about it there is a gray area about a lifetime CCW.”

“With the proper training to know when and how to use it, YES DEFINITELY.”

“It’s in our constitution, [but] I feel the states trying to regulate it is an overreach.”

“While I think it should be universal to all states, I disagree with it for the same reason I think a drivers license should not be for life.”
